The Transport Safety portfolio was established in July 2004. An increase in activity in the transport sector, the importance of improving safety in transport and the amount of work required in the transport safety area led to the Government creating a specialist portfolio1.
Roles and Responsibilities
As of 12 February 2008, the roles and responsibilities of the Transport Safety portfolio were as follows:
Rule making power under the Land Transport Act 1998, the Civil Aviation Act 1990 and the Maritime Transport Act 1994 (and any other relevant legislation). Advice on safety implications arising out of the administration of the Land Transport Management Act 2003 and the implementation of the Road Safety to 2010 strategy. Civil Aviation Amendment Bill, the Maritime Transport Amendment Bill and their implementation. Vehicle noise work, and development and monitoring a vehicle fuel consumption information measures project with the Associate Minister of Transport.
Responsibility for day-to-day issues and oversight of:
- The operational safety functions of Land Transport New Zealand, which included the approval of delegations of the Director of Land Transport’s safety powers and development and making of land transport rules and consequential regulations under the Land Transport Act 1998;
- Land Security Policy;
- The Civil Aviation Authority, signing of civil aviation rules, development of policy and regulations and approval of delegations of the Director of Civil Aviation’s powers;
- The Aviation Security service and operational and security issues of importance that were raised by the International Civil Aviation Organisation;
- The search and rescue component of Maritime New Zealand;
- Maritime New Zealand, signing maritime rules, maritime protection rules, development of regulations, and approval of delegations for the Director of Maritime’s powers;
- Maritime security policy, oil spill response incidents and issues, and International Maritime Organisation/ International Transport Federation business and international shipping/maritime conventions;
- The Transport Accident Investigation Commission;
- Relations with Met Service New Zealand, which included the government contract with Met Service New Zealand2.
On 1 August 2008 the New Zealand Transport Agency (NZTA) inherited the functions of Land Transport New Zealand, and thus the Minister of Transport Safety was responsible for the operational safety functions of NZTA.
Disestablishment
After the 2008 General Election in November 2008, the incoming National-led Government merged the responsibilities of Transport Safety with the Transport portfolio.
