Establishment

The Fire Service Council was established on 7 November 1949 under section 3 (1) of the Fire Services Act 1949.1

The Act was a response to the report of the Royal Commission to Inquire into and Report Upon Matters concerning the Fire at the Premises of Messrs J. Ballantyne and Company, Limited, City of Christchurch, on the 18th day of November 1947. The Commission suggested that urban fire brigade administration and training was inadequate, and proposed the creation of a national fire service. This was rejected by those who feared the loss of local control of fire brigades and increased costs, and the Fire Services Act (which replaced the Fire Brigades Act 1926) created the Council as a body with a national oversight over fire brigade operations.2

The Fire Service Council's first meeting was held in Wellington on 13-15 December 1949.3

Functions and Responsibilities

The functions of the Fire Service Council were:
To ensure that the fire service was maintained in a state of operational efficiency and to ensure that every Urban Fire Authority conformed with the Fire Services Act, having regard to the property which it was under an obligation to protect and to the financial capacity of the district;
To ensure effective co-ordination between all fire services, whether or not established under the Fire Services Act;
To ensure that an adequate fire safety inspectorate was established and maintained;
To assist generally in the development of the fire service.

The Council also exercised the following duties and powers:
To determine from time to time the fire service organisation and the adequacy of the water supply readily available for fire fighting purposes that was to be the minimum requirement for the formation of a united urban fire district or an urban fire district;
To determine from time to time the standards of fire service organisation that was to be the minimum requirement for the formation of a secondary urban fire district;
To determine, and from time to time to review, the fire risk category of each district;
To determine from time to time the staff establishment, operational or otherwise, necessary in each district for the efficient operation of the fire service;
To determine from time to time the ranks in the fire service;
To classify positions in the fire service of permanent Chief Fire Officers, permanent Deputy Chief Fire Officers, and such other permanent positions as the Council thought necessary, to review those classifications from time to time, and to provide facilities for inter-brigade promotion to fill those positions;
To approve appointments to the positions of permanent Chief Fire Officer, permanent Deputy Chief Fire Officer, and such other permanent ranks as the Council from time to time determined;
To direct generally the training of members of the fire service, to maintain and organise training facilities for those members, and, as the Council thought fit, to provide courses of training for those members and to assist in the training of other persons in fire fighting and fire safety;
To provide for the training and inspection of fire brigades;
To provide for such degree of standardisation of equipment and training as the Council considers necessary;
To enter into arrangements on behalf of Urban Fire Authorities for the bulk purchase of equipment in any case where the Council considers it necessary or expedient to do so;
To provide such reserves of equipment for emergencies as the Council thinks fit and to provide for the storage, maintenance, and distribution of such equipment;
To approve, amend, or determine estimates of expenditure of every Urban Fire Authority (i.e. Fire Boards);
To establish and maintain registers of volunteer fire brigades and industrial fire brigades;
To co-ordinate the units of the fire services, whether or not established under this Act, for the purposes of rural fire protection, reinforcement at serious fires, and fire protection in the event of war or civil defence emergency;
To undertake directly or to encourage and supervise experimental or research work in respect of fire service methods, equipment, and organisation and to maintain effective co-ordination with other organisations in such activities;
To organise, establish, and direct an adequate fire safety inspectorate, either directly or through fire authorities and otherwise encourage fire safety activities;
To publish reports, information, and advice on fire service matters;
Generally to review and to report to the Minister on such matters relating to the fire service and to fire safety as may be determined by the Council or referred to the Council by the Minister;
To perform such other duties for the purposes of the Fire Services Act as may from time to time be directed by the Minister of Internal Affairs in writing or prescribed by the Governor-General by Order in Council.

Structure

The Fire Service Council was a body corporate having perpetual succession and a common seal, and the power to acquire, hold and dispose of real and personal property, to sue and be sued, and do and suffer all such acts and things that bodies corporate did and suffered. In accordance with the Local Government Loans Board Act 1926, Local Authorities Loans Act 1956, and the Public Revenues Acts of 1926 and 1953, the Council was deemed to be a local authority.

Under the Fire Services Act 1949, the Fire Service Council consisted of seven members, made up of:
Two persons appointed by the Minister of Internal Affairs;
One person appointed by the Insurance Council of New Zealand (known as the Council of Fire and Accident Underwriters' Associations of New Zealand until 1967);
One person appointed by the Municipal Association of New Zealand (Incorporated);
One person appointed by the New Zealand Urban Fire Authorities' Association Incorporated (formerly known as the New Zealand Fire Boards' Association);
One person appointed by the New Zealand Federated Fire Brigade Employees' Industrial Association of Workers;
One person appointed by the United Fire Brigades' Association of New Zealand.

An additional member was added to the Council under the Fire Services Amendment Act 1962, who was appointed by New Zealand Counties Association Incorporated. A Secretary was appointed to provide administrative assistance to the Council.

Pursuant to the Fire Services Act 1972, the composition of the Council was reconstituted:
A Chairman, who was appointed by the Minister of Local Government by notice in the New Zealand Gazette;
Seven other persons appointed by the Minister by notice in the New Zealand Gazette, each of who was nominated by (i) the Insurance Council of New Zealand; (ii) the Municipal Association of New Zealand (Incorporated); (iii) the New Zealand Counties' Association Incorporated; (iv) the New Zealand Urban Fire Authorities' Association Incorporated; (v) the industrial unions of fire brigade employees that were registered under the Industrial Conciliation and Arbitration Act 1954 (replaced by the Industrial Relations Act 1973); (vi) the United Fire Brigades' Association of New Zealand; (vii) the New Zealand Executive Fire Officers' Society (Incorporated); and
the Secretary for Local Government.

The Chief Fire Service Officer (known as the Chief Officer up to early 1973) was responsible for the direction of all technical matters, including training; the direction and control of all technical staff employed or seconded to the Council; and for issuing instructions to Fire Boards and Fire Brigades regarding the maintenance of equipment, methods of fire brigade training (either singly or in co-operation with other brigades), or co-ordinating in the event of war or civil defence emergency.

Assisting the Chief Fire Service Officer was the Deputy Chief Fire Service Officer (who also exercised the Chief Fire Service Officer’s functions and responsibilities in their absence), the Director of Inspection and Research, the Director of Fire Safety, and the Director of Training.

The New Zealand Fire Service College, which was based in Island Bay, Wellington, was established and operated by the Council.

The Council established three advisory committees to assist it in carrying out its functions:
Technical Advisory Committee;
Training Advisory Committee; and
Metrication Advisory Committee

Disestablishment

The Fire Service Council was abolished on 1 August 1974 under section 3 (7) of the Fire Services Amendment Act 1974, and was replaced by a newly established Fire Service Commission. All real and personal property, contracts, debts, engagements, and liabilities of the Council were vested in the Commission.
