Establishment

The Canterbury Earthquake Recovery Authority (CERA) was established by the Government on 29 March 2011 under the provisions of the State Sector (Canterbury Earthquake Recovery Authority) Order 2011. The Authority was created in response to the serious damage caused to Canterbury, and in particular Christchurch City, by a 6.3 magnitude earthquake on 22 February (at 12.51 P.M. local time) the same year. The earthquake was an aftershock to the one that occurred in Canterbury on 4 September 2010.

The Canterbury Earthquake Recovery Commission, formed to co-ordinate recovery and rebuilding efforts after the 4 September earthquake, was dissolved on 19 April 2011, leaving CERA responsible for all recovery and rebuilding efforts.

Functions and Responsibilities

Through its chief executive, CERA had the following functions under section 9 of the Canterbury Earthquake Recovery Act 2011:

  • developing a Recovery Strategy for submission to the Minister for Canterbury Earthquake Recovery;
  • reviewing and preparing amendments of a Recovery Strategy;
  • developing a Recovery Plan when directed to do so by the Minister;
  • consenting to specified types of contracts that councils could enter into;
  • requiring the provision of information, disseminating information, commissioning reports, and carrying out investigations;
  • exercising qualified powers to enter property;
  • directing the approval of cadastral survey datasets by Land Information New Zealand and processes for the issuing of computer registers by the Registrar-General of Land;
  • carrying out and commissioning building, demolition, and removal work;
  • restricting access to specified buildings and areas;
  • partially or totally closing roads or restricting access to roads;
  • giving directions to a property owner where they have a sufficiently linked interest to act for the benefit of an adjoining owner;
  • acquiring, selling, and otherwise dealing with land and property;
  • receiving claims for compensation;
  • applying to the High Court for compliance orders where compliance with a direction has not occurred;
  • giving effect to other matters that may be delegated to the Authority (and the chief executive) by the Minister;
  • any other functions provided in the Act.1

Structure

CERA was headed by a Chief Executive, who was responsible to the Minister for Canterbury Earthquake Recovery. The Authority was in-part be staffed by secondees from government ministries with a direct interest in the recovery process.2

CERA co-ordinated recovery and rebuilding efforts in collaboration with the Christchurch City Council, Selwyn District Council, Waimakariri District Council and Environment Canterbury, central government departments and Crown entities, infrastructure providers and construction firms, and engaged with the local communities of greater Christchurch, including Ngai Tahu, the private sector and business interests.3

Disestablishment

CERA was disestablished on 18 April 2016. The existing functions and work of CERA were taken over by a combination of central and local government agencies:

  • The Ministry of Health and the Canterbury Health Board
  • Land Information New Zealand
  • The Ministry of Business, Innovation and Employment
  • Otakaro Limited
  • Regenerate Christchurch
  • The Greater Christchurch Group in the Department of the Prime Minister and Cabinet
