Probate files contain all the legal documentation required for the granting of probate on a will. However not everyone who had made a will has a probate file. The size of the estate was a determining factor in whether wills went to probate. Those wills, which were probated, were usually lodged in the Supreme/High Court nearest to where the deceased resided. If a person died without making a will, then there may be a file of Letters of Administration, containing the legal documentation required for the administration of the deceased person's estate.
Probate files contain some, or all, of the following types of documentation:
· Motion paper
· Affidavits of witnesses or executors
· Affidavit of death
· Filed accounts
· Will
· Probate paper
· Inventory
· Codicils
· Miscellaneous
 
Where Letters of Administration only have been lodged, i.e., the individual has died intestate and no will has been made, some of the following types of documentation will be found:
· Petition by administrator
· Administration bond
· Accounts
· Motion paper for the grant of letters of administration
· Affidavits
· Affidavit of justification of sureties
· Letters of administration
· Miscellaneous.
