This series contains the land or remission claim applications (Claim to Grant of Land or Remission of Purchase Money) that were submitted to the Naval and Military and Local Forces Land Claims Commission of 1882, for consideration.
The applications are arranged into 3 groups – Rejected Claims, Recommended Claims, and Late Claims. Rejected and recommended claims are classified by a running number system, between 1 and 1582. Late applications used a multiple number system, numbered between 3/1 and 3/84.
Most of the applications consist of an application form and a copy of the letter send to the claimants from the Commission (including the envelope). In many cases, supporting documents are attached.
Some or all of the following information is recorded on the claim application form:

On some forms, the envelope the claim was sent in is attached.
Also included on the form is the Signature of Claimant and Date the claimant signed the application. The Commissioners or Commission staffers annotated the form to indicate whether a claim was recommended or rejected.
Supporting documents sometimes include correspondence from a commanding officer of the service or unit the claimant served in, claim schedules (which document military service or unit, service periods, claimant’s commanding officer, Act Ordinance or Regulations that the claim was being made under, and whether previous claims had been made or settled), copies of forms letter recommending or rejecting a claim, minutes from the Commission hearings relating to the claim, and a declaration form (including the ‘stamp duty’ stamp).
Land Claims Investigated1
The claims the Commission investigated were of two classes – those that arose under the Waste Lands Act 1858 (under section 15), and the Auckland Provincial Ordinance entitled the Auckland Waste Lands Act 1858 (under sections 80 to 82); and those made under the Volunteers Land Act 1865, and the Provincial Acts and Ordinances passed under the authority of that Act.
Waste Lands Act 1858 and Auckland Waste Lands Act 1858
These Acts were in effect in the North Island only. Under the legislation, naval and military settlers were declared to be entitled to certain areas of land in proportion to their rank, free of cost, provided that they left the service for the purpose of settling in any of the three provinces the North Island was originally divided (Auckland, New Plymouth/Taranaki, and Wellington). These Acts were repealed in the mid-1860’s – in Auckland c.1861, Wellington in 1863, and Taranaki, in 1865.
Volunteers Land Act 1865
The Volunteers Land Act 1865 empowered Provincial Superintendents, with consent of their Provincial Council, to grant scrip not exceeding £30 to every efficient Volunteer after five years’ service, and an additional £5 for every six months’ actual service against the enemy. This Act was adopted in the Provinces of the North Island as follows: - Wellington, in 1867: Taranaki, in 1872; Hawke’s Bay, in 1868 (for 2 years only); and in Auckland, in 1869.
By the Volunteers Land Act Amendment Act 1867, Volunteers enrolled prior to 1 January 1866, were deemed to be “efficient.”
A further amendment, the Volunteers Land Act 1865 Amendment Act 1873, further declared that all claims for remission to which the applicants were then entitled, and all claims for the exercise of scrip already issued, would be barred unless made within twelve months of the commencement of the Act. This was acted upon by the Provinces of Wellington in 1869 by the Act to Amend the Volunteer Free Grants Act 1867, but the privilege was afterwards extended to men enrolled before 30 September 1872.
Waste lands Administration Act 1876
Section 3 of this Act repealed all previous legislation relating to naval and military land claims, and declared that no certificate of remission could be made except at the expiration of the full term of service in respect of remission certificates that were authorised to be granted to such volunteers who, at the time of the coming into operation of the Act, had completed three years or more of service.
Claims under this provision had to be made within six months of their maturing.
Claims that volunteers were entitled to at the time of the Act were barred unless they were made within twelve months from the date of enactment. This period was extended by 6 months under section 3 of the Volunteers and Other Lands Act 1877, through to 30 April 1878.
The Crown Lands Sale Act 1877, extended the time for exercising scrip to 30 April 1879, provided the scrip was held by the Volunteers.
