This restriction is necessitated by the identification of copies of court documents in a range of Ministry files held at Archives New Zealand. 100 years is the restriction that applies to most criminal and family related court records stored at Archives New Zealand. Given that the examples of court documents identified in Ministry files mainly relate to criminal and family related matters, implementing a 100-year access restriction in all Ministry records is appropriate.
Some of the court documents will be subject to suppression or other restrictions imposed by the judiciary.
Many of the records also include personal information of identifiable individuals and are subject to restriction under the Privacy Act 1993.
