These applications were filed under the provisions of the Mortgagors and Tenants Relief Act 1933, for relief from mortgages or rent during the depression.  The applications were heard by the Balclutha Magistrate's Court, and from 1935 rural applications were heard by the Court of Review based at the Balclutha Court.  The Court could postpone payments of interest, reduce the rate of interest payable or remit totally any arrears of interest payable.  The Otago Adjustment Commission was charged with reporting on cases referred to them.

The Mortgagors and Tenants Relief Act 1933 was repealed by the Mortgagors and Lessees Rehabilitation Act 1936.  All mortgagors or tenants protected by the 1933 Act were required to make applications under the 1936 Act for continuing adjustments of their liabilities.
