Each warrant consists of a large printed sheet, folded in half and bound into a volume. Each sheet lists several different pieces of land. A Warrant is a legal instrument which conveys land ownership from the Crown to an individual. Under the Land Transfer Act Amendment Act 1880, a schedule of people who had purchased land was sent to the Governor for signature. Once signed, this became a Warrant for the issue of a Certificate of Title. From 1950, some groups of numbers in the sequence were separated out and used for the South Auckland Land District - for example, numbers 5101-5200. These were bound into separate volumes, and became a new series kept in the Hamilton office.

	Warrants 

	

	A Warrant is a legal instrument which conveys land ownership from the Crown to an individual. Under the Land Transfer Act Amendment Act 1880, a schedule of people who had purchased land was sent to the Governor for signature. Once signed, this became a Warrant for the issue of a Certificate of Title. The warrants are written in ink on pre-printed forms, headed "Land Registration District of Auckland, Colony of New Zealand", and the legislation under which the warrants were issued is also stated.

	Information given in the warrants includes the legislation under which the warrant was issued; land description; area in acres, roods, and perches; name and occupation of person entitled to Crown Grant; payment; fees; nature of interest (eg freehold); date from which entitled, and a cross-reference to a volume and folio number - possibly of the Certificate of Title registers.

	The warrants are signed first by the Receiver of Land Revenue to certify that the land has been paid for, all fees paid and that the particulars are true. Next they are signed by the Surveyor-General, certifying that the land description on the Warrant is sufficient to identify the land on the public map deposited in the Office of the Commissioner of Crown Lands. Finally, the Governor's signature authorises the District Land Registrar, Auckland to issue Certificates of Title for each of the pieces of land in the schedule.

	 Predecessor and Successor Series:

	

	Crown Grants, Warrants, and 116 Certificates are the legal instruments used by the Crown to vest land ownership in private hands. Each instrument is authorised by different legislation however all three instruments continue to be used today.

	

	Warrants superseded Crown Grants as the most common instrument in 1880, and Warrants were in turn superseded by 116 Certificates in 1952.

	

	With the passing of the Land Act 1948, the system of land registration changed and warrants became optional. Instead, the Department of Lands and Survey could issue a certificate [Section 116 certificate, Series 592] for the issue of a certificate of title: this certificate went to the District Land Registrar, with one copy being sent to the Lands and Survey Head Office, and another being kept in the appropriate district office. From then on, warrants were only issued in special circumstances.

	

	Controlling agencies:

	

	Although this series was controlled by the District Land Registry, it originated in the District Office of the Department of Lands and Survey (BAAZ). The warrants were prepared by the latter agency and sent from there to be signed by the Governor-General. They were then sent to the Land Registrar who issued a certificate of title to replace the provisional title previously issued.

	

	Function, and related series: 

	

	The forms comprising this series were duplicated in series held by the Head Office and District Office of the Department of Lands and Survey (series 591 and 1174). The function of these forms was outlined retrospectively in a letter to National Archives from Lands and Survey in 1968:

	

	The procedure to give title to land was at that time to issue a certificate of purchase to the District Land Registrar signed by the Commissioner of Crown Lands and this was followed by the issue of a warrant signed by the Governor-General. The original of the Certificates [1169] lodged with the District Land Registrar were registered by him and thereon constituted Provisional Title to the land [see Provisional Registers]. When the original warrant [1170] was received by the District Land Registrar he would cancel the provisional title and issue a full certificate of title. An extra copy of the Warrant [591] signed by the Governor-General was retained in Head Office. The copies of warrants held by Lands and Survey district offices for their records [1174] are unsigned copies. [Correspondence on file NA 2/27/1 vol 4, copy on AT 86/10].

	

	The destruction of district-office copies was approved by National Archives in 1968.
