Palmerston North Maintenance Order Books are restricted for 100 years from date of last entry.
Researchers may apply to the Court Registrar/Judge for permission to inspect records before the end of the restricted period. If access permission is granted the Registrar/Judge should also indicate whether the applicant has permission to publish. Any permission to publish is subject to any legislation prohibiting publication (e.g. Family Proceedings Act 1980) or any Court Order specifying contents or name suppression. Where this is the case permission to publish must clearly relate to the relevant Court order or legislation. A copy of the permission letter should be forwarded to the Archives New Zealand Office holding the records. Permission to access or copy records does not automatically include the right to publish. Even unrestricted records may require separate permission in order to publish.
Permission to access restricted registers
Date ranges of registers may sometimes differ to what appears in Archway, as later amendments have been added by the courts.ย ย Registers therefore need to be checked prior to release to confirm their date range and whether they are outside the 100 year restriction period.
Researchers wishing to access restricted registers should begin by contacting Archives New Zealand to confirm the date range of the register they wish to view.ย Archives New Zealand will complete a check of the register, inform the researcher of the date range, and make any necessary updates to the listing for the register.ย If the register remains within the 100 year restriction period the researcher should then contact the Wellington High Court to request access, providing the register details.
Note for Archives staff
- Registers remain restricted until they are marked as O (open) access.ย Open access registers appear with a green access status.
- Registers which remain restricted but have been checked have been set to status R (restricted).ย They are restricted for 100 years from the last date of entry, based on a full check of register contents, and will then become open for public access.ย These registers appear with a red access status.
- Registers which remain restricted but have not yet been checked have been set to status M (may be restricted).ย They have an interim restriction of 100 years from the last date of entry, based on the existing listing for each register.ย The contents of these registers need to be checked before release to confirm that they have the correct date range and restriction expiry year in place.ย These registers appear with an orange access status.
