ACCESS CONDITIONS ON HIGH COURT, DISTRICT COURT AND WARDENS COURT RECORDS
These access provisions apply to all High Court records, District Court records and Wardens Court records held by Archives New Zealand.
Permission to access and permission to publish:
Some material has restrictions placed on use and publication: Refer to DA053 Department for Courts, Courts Disposal Schedule Instructions, Section 4, Access Provisions, for specific provisions. Files with such restrictions have been individually identified on the series list(s).
Children's Court case files and Miscellaneous case files in this series are restricted for 60 years from last date of entry
For some records researchers may apply to the Court Registrar/Judge for permission to inspect records before the end of the restricted period. If access permission is granted the Registrar/Judge should also indicate whether the applicant has permission to publish. Any permission to publish is subject to any legislation prohibiting publication (e.g. Family Proceedings Act 1980) or any Court Order specifying contents or name suppression. Where this is the case permission to publish must clearly relate to the relevant Court order or legislation. A copy of the permission letter should be forwarded to the Archives New Zealand Office holding the records. Permission to access or copy records does not automatically include the right to publish. Even unrestricted records may require separate permission in order to publish.
Section 20(1)(c) and 20(1)(c)(a) of the Archives Act 1957 specifically restricts access to information concerning the trial or punishment of individuals. Applications for access to records containing such information must be made to the Minister for Courts or Corrections respectively. Any application for access must specify if the researcher wants access only, or access and permission to publish any information contained in the item.
