One of the duties of the newly appointed Secretary of Crown Lands under the Waste Lands Act 1858 was management of all publicly-owned land reserved or set apart for the purposes of public utility or convenience.
In 1887, Te Heuheu and other Maori chiefs gifted to the Crown all the land within a radius of 1 mile of the summits of Tongariro, Ruapehu and Ngauruhoe on the condition that the land would be preserved as a national park for all the people of New Zealand. In 1893, the Minister of Lands was appointed the Commissioner of Forests and the following year, the Tongariro National Park Act was passed, constituting the three peaks and surrounding land as the first national park.
Under section 235(4) of the Land Act 1892, the Governor could reserve Crown land for purposes that specifically included “the growth and preservation of timber or the preservation of native fauna”. Both Resolution Island and Little Barrier Island were reserved as bird sanctuaries. In 1897, the island of Kapiti was acquired by the Crown as a public preserve for the flora and fauna of New Zealand.
In 1900, a second national park was established at Egmont after representations from Taranaki settlers who were anxious to see the forests on the mountain slopes preserved to safeguard the catchment and protect their land from excess run-off.
Action to reserve land for scenic purposes was taken with the 1903 Scenery Preservation Act, which established a commission to report on lands worthy of acquisition and preservation. In 1905, the Fiordland area, famous for its spectacular lakes and fiords, was proclaimed a national reserve to be administered under the 1903 Act, with a view to its later establishment as a national park in 1952.
The growing interest in the country’s scenery and the scientific importance of the native flora and fauna, led to the passing in 1928 of the Public Reserves, Domains and National Parks Act which allowed the government to declare areas as national parks without specific acts of parliament.
Under the Forests Act 1949, State forest land could be set apart as forest sanctuaries with restricted public rights of access, in order to preserve indigenous flora and fauna and for scientific purposes.
The National Parks Act of 1952 consolidated the administration of the existing national parks and established a National Parks Authority with policy-making and financial responsibilities, and established separate park boards for the routine administration of each park. Five national parks and three maritime parks were formally established under the Act. Each of the maritime parks incorporated a number of existing historic, scenic, recreation and nature reserves.
Provision was made under the Reserves and Domains Act 1953 for the creation and protection of private scenic reserves.
In 1962 the Nature Conservation Council was established to co-ordinate scientific and technical information on nature conservation and enquire into the effect of proposed public works.
The Marine Reserves Act 1971 formally provided for the setting up and management of areas of the sea and foreshore as marine reserves for scientific study, and transferred administration of marine reserves to the Department of Agriculture and Fisheries in 1972. Subsequently in 1975, the first marine reserve was set up at Cape Rodney-Okakari Point near Leigh, north of Auckland.
Under the Reserves Act 1977, the classification and management of reserves were standardised into 8 categories: national, recreation, historic, scenic, nature, scientific, government purposes, local purposes and wilderness.
The 1980 National Parks Act replaced the 1952 Act and established the National Parks and Reserves Authority with similar responsibilities.
In 1987 the Conservation Act established a separate department that assumed statutory responsibility for all national parks and reserves (including maritime).
