[history] => The Plant Variety Rights Office was established by the Plant Variety Act 1973, and headed by a Registrar of Plant Variety Rights. The Office was charged with receiving applications from breeders and awarding exclusive rights of commercialisation to those who satisfied legislative criteria. Rights were granted for a prescribed number of years, and included the exclusive right to produce and sell reproductive material from the plant. The Office functioned under the authority of the Ministry of Agriculture and Fisheries. Appeals from the decisions of the Office were to an Appeal Authority also established under the Act.
The Plant Variety Act 1987 did not alter the Office structure, but replaced the position of Registrar with that of Commissioner. The Act also abolished the Appeals Authority, allowing direct appeal to the District Court against decisions of the Office.
The Plant Variety Rights Amendment Act 1990 removed the Office from the Ministry of Agriculture and Fisheries. It was instead placed under the control of the Ministry of Commerce, which subsequently became the Ministry of Economic Development in 2000.
