Establishment
The New Zealand Society of Conveyancers (NZSOC) was established on 1 August 2008 under the provisions of the Lawyers and Conveyancers Act 2006 and the Lawyers and Conveyancers Act Commencement Order 2008 (SR 2008/182). Prior to this date all law practitioners were regulated by the New Zealand Law Society under the Law Practitioners Acts and amendments.
Functions and Responsibilities
The purpose of the New Zealand Society of Conveyancers was:
- to regulate certified Conveyancing Practitioners in the industry;
- to represent the Conveyancing Profession and its members;
- to promote and improve the Conveyancing Profession;
- to promote the Diploma of Conveyancing;
- to encourage principled conduct and the use of best practices throughout the Conveyancing profession.1
Under the Lawyers and Conveyancers Act 2006, the regulatory functions of the New Zealand Society of Conveyancers were defined as:
- to control and regulate the practice in New Zealand by conveyancers of the profession of conveyancing;
- to uphold the fundamental obligations imposed on conveyancing practitioners who provide regulated services;
- to monitor and enforce the provisions of the Act, and of any regulations and rules made under it, that related to the regulation of conveyancing practitioners;
- to perform and exercise, in relation to the profession of conveyancing, functions and powers similar to those that were conferred on the New Zealand Council of Legal Education under sections 274 and 275 of the Act.
The representative functions of NZSOC were to represent its members and to serve their interests.
In carrying out its functions, the Society was authorised:
- to provide or arrange for the provision of services and facilities for conveyancing practitioners, including seminars and educational and training services and facilities;
- to publish periodicals, pamphlets, and other materials;
- to establish or join in establishing any body, whether incorporated or not, and whether in New Zealand or elsewhere, for the purpose of the exercise of any of the Society's representative functions or powers.
In its representative capacity, NZSOC could provide and charge for services, including premises, for the purpose of the Society's regulatory functions and powers. Charges for the provision of such services were not allowed to exceed fair market rates.
Structure2
The Society was governed by a Council, which consisted of up to 7 councillors including a president and vice president. Councillors were elected by the membership of the Society at its annual general meetings, and served for a period of 1 year. Where a vacancy occurred, the position could be filled by appointment by the Council from the membership of the Society, for the duration of the current term. Only full members and life members of NZSOC were eligible for election or appointment to the Council.
A Secretary was also appointed to provide administrative assistance.
The Council also acted as the Society's Executive Board. Three special committees were established by NZSOC to assist it in carrying out its responsibilities:
- Regulatory Authority;
- Complaints and Standards;
- Special Funds.
