Establishment
The Civil Service Officers' Guarantee Board was established as the Government Officers' Guarantee Board under the Government Officers' Guarantee Act 1870. An interim board, headed by Jonas Woodward, appears to have been appointed by the Colonial Secretary between September and November 1870, for the purpose of drafting regulations under the Act.1
The draft regulations were presented to the Colonial Secretary on 8 December 1870, and were issued by the Governor by Order in Council on 27 January 1871.2
The interim board was formally appointed in accordance with regulations on 3 February 1871:
- George Sission Cooper, Under Secretary;
- Jonas Woodward, Assistant Treasurer;
- Charles Thomas Batkin, Paymaster-General;
- George Eliott Eliott, Secretary, General Post Office;
- William Seed, Secretary, Customs Department.3
Mutual Guarantee system of insurance of the fidelity of officers in the New Zealand Civil Service
The mutual guarantee system of insurance of fidelity of officers in the New Zealand Civil Service operated under regulations issued by Order in Council - Regulations under "The Government Officers Guarantee Act 1870" (issued 27 January 1871), the Amended Regulations Under "The Government Officers Guarantee Act 1870" (issued 10 November 1874), and Regulations under "The Civil Service Officers' Guarantee Act 1893" (issued 4 March 1895).
The system applied to all officers permanently employed in the Civil Service (except for those exempted by the Acts or regulations) over a certain amount of salary, who were assured for an amount determined by regulations. Whenever an officer committed a defalcation (i.e. stole, misused, or misappropriated money or funds they were responsible for), all persons assured were liable to pay a portion of the amount of the defalcation.
Whenever a defalcation by an assurer (the defaulter) had occurred and the amount of defalcation had been determined and certified by the Controller and Auditor General, the permanent head of the department where the defalcation occurred was required to notify the Chair of the Board of the amount of salary or other moneys payable. On receipt of the notice of a defalcation, the Board assessed on the total sum assured the rate percentage required to cover the default. The Board was then required to issue notice in the New Zealand Gazette (notice of call) to authorise deduction from the salaries of assurers to meet the default.
Immediately after publication of the Gazette notice, the Chair of the Board forwarded to the Paymaster-General (a position within the Treasury Department) a schedule showing the amounts recoverable from all assurers. The Paymaster-General was then responsible for recovering from the assurers the amount each was liable for, paying the moneys into the Civil Service Officers’ Guarantee Account.
One-fortieth of the defalcation amount was required to be paid by The Treasury (Colonial Treasurer/Minister of Finance) after a notice of call was published in the Gazette.
Functions and Responsibilities
The Civil Service Officers’ Guarantee Board was responsible for administering the mutual guarantee system of insurance of the fidelity of officers in the New Zealand Civil Service, established under the Government Officers’ Guarantee Act 1870, the Civil Service Officers’ Guarantee Act 1893 and the Part III of the Civil Service Act 1908.
The Board carried out the following activities:
- Preparing and maintaining annual rolls of assurers.
- Notifying the officers assured of the amount for which they were assured.
- On receipt of notification of a defalcation, assessing the rate percentage to cover a default.
- Notifying the authorisation of deductions from salaries of assurers to meet a default (published in the New Zealand Gazette).
- Managing the Civil Service Officers’ Guarantee Account.
- Keeping proper accounts of all moneys received and paid by it (audited annually by the Controller and Auditor-General).
- Receiving and considering confidential reports and communications on matters concerning the integrity of any officer, and act as appropriate.
Structure
The Civil Service Officers’ Guarantee Board consisted of five members, three of whom were selected from amongst the assured. All appointments and removals were made by the Governor. On the removal, resignation, death, or retirement of any board member, the Governor appointed a successor.
The chair of the Board was elected annually. In January each year, the Board was required to assemble and elect one of their members to be chair who held office until the next annual election.
If the chair resigned, died, or was removed for office during the year the Board was required to immediately elect one of their members to be chair, who held office until the next annual election.
Disestablishment
The Civil Service Officers’ Guarantee Board was abolished on 14 August 1914 with the repeal of Part III (Officers’ Guarantee) of the Civil Service Act 1908, pursuant to section 2 of the Civil Service Officers’ Guarantee Repeal Act 1914.
