Establishment

The Industries Development Commission was established on 1 June 1962 as the Tariff and Development Board pursuant to section 3(1) of the Tariff and Development Board Act 1961 and the Tariff and Development Board Act Commencement Order 1962 (SR 1962/79). It replaced the Board of Trade which had been established under the Board of Trade Act 1950.

On 19 September 1975 the Board was renamed the Industries Development Commission, as set out under section 3(1) of the Industries Development Commission Amendment Act 1975 (this amendment also renamed the principal Act, the Tariff and Development Board Act 1961, as the Industries Development Commission Act 1961).

Functions and Responsibilities

The function of the Industries Development Commission was, when requested by the Minister of Customs or the Minister of Trade and Industries or the Minister of Overseas Trade, to inquire into and report to the Minister on any of the following matters, with such recommendations as it thought fit:

The desirability of new, increased, or reduced Customs duties, or of exemptions from such duties;

  • The general effect of the operation of the Tariff on the trade and commerce and the farming, manufacturing, and distributing industries of New Zealand and also on the interests of consumers;
  • The desirability of providing or continuing to provide assistance, whether by means of subsidies, grants, bounties, Tariff concessions or preferences, or otherwise, for the protection and encouragement of any New Zealand industry or for the development of New Zealand's overseas trade;
  • The relationship between the rates of Customs duties on raw materials and those on finished or partly finished products;
  • Any matter relating to the licensing of imports, including any appeal against a decision to decline, in whole or in part, any application for an import licence;
  • Any matter relating to the application of Customs duty under any item of the Tariff, or to the granting of concessions as was provided for in the Tariff or in the Customs Acts;
  • Any other matter affecting the protection or development of industry or the development of overseas trade, whether by means of the Tariff or otherwise.

The Commission was also empowered to carry out its own inquiries into and make recommendations to any of the Ministers on any matter of policy within its ambit.

Structure

On establishment, the Industries Development Commission consisted of 4 to 6 members, who were appointed by the Governor-General on the recommendation of the Minister of Trade and Industry (the Minister of Industries and Commerce until 1972). Membership increased to 8 in October 1969.

One member of the Commission was appointed Chairperson, and another member was made Deputy Chairperson.

Initially members were appointed for a term of 3 years, which was increased to up to 5 years from September 1975.

The Industries Development Commission Amendment Act 1979 (enacted on 30 November 1979) reduced the membership of the Commission to 5. It also allowed for the appointment of associate members by the Minister of Trade and Industry, after consultation with the Minister of Customs, the Minister of Overseas Trade and the Chairperson of the Commission. Associate members were appointed for specific industry studies in which the member had expertise.1

For the purposes of the Industries Development Commission Act 1961, the Commission was considered to be a Commission of Inquiry under the Commissions of Inquiry Act 1908, and it could hold public inquiries and summon persons to give evidence in accordance with the Act.

The Department of Trade and Industry (known as the Department of Industries and Commerce until 1972) provided administrative support to the Commission.2

Disestablishment 

The Industries Development Commission was disestablished on 13 June 1987 with enactment of the Temporary Safeguard Authorities Act 1987, which repealed the Industries Development Commission Act 1961 under section 12(1).
