The aim of the Casino Control Act was to:
Authorise the establishment and operation of licensed casinos
Promote casino development in a manner consistent with promotion of tourism, employment and economic development
Provide for the regulation of casinos in the public interest
The functions of the Authority were:
To consider applications for, and to grant, casino licences
To determine the conditions of licences that were issued
To consider and determine appeal in relation to the issue, cancellation, and suspension of certificates of approval for casino employees
To advise the Minister of Internal Affairs on matters relating to the administration of the Casino Control Act and regulations made under the Act
To determine policy in relation to the supervision and inspection of casinos
To approve the games to be played in casinos and the rules under which such games were to be played
To carry out such other functions as are conferred on the Authority by or under the Act, including the consideration of various types of application by or relating to casino licensees
The Authority was made up of six members who were appointed for terms of not more than three years, by the Governor-General on the recommendation of the Minister of Internal Affairs. The Casino Control Act specified that the Chairperson of the Authority had to be a barrister and solicitor of the High Court of New Zealand who had not less than seven years’ legal experience. The remaining five members of the Authority were appointed by virtue of their knowledge, experience, or expertise.
The Act also empowered the Authority to appoint staff necessary for it to carry out its functions, and employ experts when required. Administrative support was usually provided by the Gaming Regulation Division of the Department of Internal Affairs.
In 2003, the Gambling Act was enacted. Under the Act, casino venue licensing ceased, and the responsibility for regulation of the gambling sector was to be shared by the Gambling Commission (which was established in February 2004), the Department of Internal Affairs, and the Ministry of Health. The Gambling Act also repealed the Casino Control Act, and provided for the dissolution of the Authority.
The Casino Control Authority relinquished its core functions on 30 June 2004. The Gambling Commission became responsible for dealing with casino licensing, casino licensing conditions, and appeals against decisions, while the Department of Internal Affairs was responsible for casino game rules, minimum operating standards, and minimum equipment standards.
The Authority was formally disestablished on 1 October 2004.
