	The establishment of a Patent Office, and of the position of a Patents Officer, was provided for by the Patents Act 1870. Prior to 1870, the registration of patents had been the responsibility of the Colonial Secretary's Department. In the early period the administration of patents was no more than the registration of applications - issues beyond this were decided by the courts. Legislation in 1882 provided for the examination of specifications prior to registration and for the creation of district offices, which by 1885 were established at each main centre, attached to court offices. In association with this change the control of the Patent Office moved from the Colonial Secretary's Department to the Justice Department.

	

	In 1889 an Act was passed which provided for the administration of Trade Marks and Design copyrights by the Patent Office, and which renamed the Patent Officer the Registrar of Patents, Designs and Trade-Marks. Trade Mark registrations had previously been carried out by the Colonial Secretary's Department under the Trade Marks Act 1866.

	

	From approximately 1886 the Patent Office was responsible for administering copyright legislation. The copyright branch of the Patent Office closed following the abolition of government administration of copyrights in 1962.

	

	The functions of the Patent Office included the administration of legislation providing for the protection of intellectual property rights, by granting patents under the Patents Act 1953 and by registering trade marks and designs under the Trade Marks Act 1953,  Trades Marks Act 2002 and Designs Act 1953. It examined applications and granted patents, trade marks and designs. It provided public records on granted patents and registered trade marks and designs. The Patent Office also made available technical information in patent specifications and provided advice on whether trade marks applications might conflict with registered trade marks. The Patent Office was headed by a Commissioner of Patents, Trade Marks and Designs, an Assistant Commissioner of Patents and an Assistant Commissioner of Trade Marks and Designs.

	The Patents Office also administered the Plant Variety Rights Act 1987.

	

	In 1995 the New Zealand Patent Office came under the control of the Ministry of Commerce. In late 1997 the New Zealand Patent Office changed its name to the Intellectual Property Office of New Zealand. However, its functions have remained essentially the same.
