	This series contains applications for adjustment of mortgage and lease liabilities that were processed by the Lower Hutt Court of Review and the Hutt (Urban) Adjustment Commission.

	Procedure1

	All applications were made pursuant to the Mortgagors and Lessees Rehabilitation Act 1936, which could be made on mortgages and leases the following classes :-

	

		Mortgages that were executed before the passing of the Act;
	

		Mortgages that were in fact operative or designed to take effect before the date of the passing of the Act, though not executed before that date;
	

		Mortgages to which the Act had at any time applied and which had been varied by the parties thereto;
	

		Mortgages that had been executed in replacement or substantial replacement of mortgages to which the Act had at any time applied;
	

		Leases that were executed before the passing of the Act; and
	

		Leases that had been executed in renewal of such leases.


	Any mortgagor, lessee, or guarantor under a mortgage or lease to which the Act applied could make application for an adjustment of their liabilities. Every application was required to contain a complete list of all the creditors and debtors of the applicant, together with a statement of their assets and liabilities and of the securities held by secured creditors. No application could be filed after 31 January 1937, although the Court of Review had the discretion to accept applications in special circumstances to 28 February 1937.

	Where a mortgagor or lessee had made default in complying with their obligations under a mortgage or lease but had not filed any application for relief, the mortgagee or lessor or any guarantor in respect of the mortgage or lease could make application - on or before 31 January 1937 - for adjustment of the mortgagor's or lessee's liabilities.

	As soon as possible after the filing of any application, the Registrar of the Court was required to refer the matter to the Hutt (Urban) Adjustment Commission. Mortgagors and lessees were protected from the exercise of rights of foreclosure, in respect of mortgages or leases for which application for adjustment has been made, until such applications have been finally disposed of.
